These Terms and Conditions ("Terms") govern your access to and use of the websites, mobile applications, networks, products and services (collectively, the "Services") provided by eTrust ("we", "us", or "our"). By registering for, accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current and complete information and to keep it up to date.
We provide telecommunications and related digital services, which may include voice, data, messaging, identity verification, airtime/data top-ups, and value-added services. Service availability, coverage, speeds and features may vary by location, device and network conditions, and may change without notice.
Charges for the Services are payable in advance unless stated otherwise. Where a wallet or prepaid balance is used, you authorise us to debit applicable fees from that balance. All fees are non-refundable except where required by law or expressly stated. Prices are inclusive of applicable taxes unless indicated. You are responsible for all charges incurred under your account.
You agree not to use the Services to: (a) violate any law or regulation; (b) send spam, fraudulent, abusive, or unsolicited communications; (c) infringe the rights of others; (d) distribute malware or attempt to gain unauthorised access to any system; (e) resell the Services without authorisation; or (f) interfere with the integrity or performance of the network. We may suspend or terminate access for any breach.
To comply with regulatory requirements (including SIM registration and "Know Your Customer" obligations), you may be required to submit identity information such as your National Identification Number (NIN), BVN, or other documents. You warrant that all information provided is true and belongs to you, and you consent to its verification with the relevant authorities.
We strive to keep the Services available but do not guarantee uninterrupted or error-free operation. The Services may be unavailable during maintenance, upgrades, network faults, or events beyond our reasonable control. We are not liable for any loss arising from such interruptions.
We process personal data in accordance with applicable data-protection laws. By using the Services you consent to the collection, processing and storage of your data as necessary to deliver the Services and to meet legal obligations. We implement reasonable safeguards but cannot guarantee absolute security.
All content, trademarks, software and materials provided through the Services are owned by us or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose only.
We may suspend or terminate your access to the Services, with or without notice, where we reasonably believe you have breached these Terms, where required by law or a regulator, or to protect the network or other users. You may stop using the Services at any time.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill, arising from your use of or inability to use the Services. Our total aggregate liability shall not exceed the amount paid by you for the Services in the three (3) months preceding the claim.
You agree to indemnify and hold us harmless from any claims, damages, liabilities and expenses arising out of your use of the Services or your breach of these Terms.
We may update these Terms from time to time. Material changes will be notified through the Services or by other reasonable means. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Federal Republic of Nigeria, and you submit to the exclusive jurisdiction of its courts, without prejudice to any mandatory consumer-protection rights you may have.
